Anti Defection law

This law was announced on 1985 in India by the help of 52nd constitutional amendment. The provision of Anti defection law has been added in 10th schedule. 

According to this laws " If MP, MLA or MLC will not follow the  party's command than his or her membership will be disqualified. 

Arguments in favour of Anti-Defection law

  • It provides stability to the government
  • It ensures that MP and MLA will be loyal or reliable to party policies. 
  • It promotes party discipline. 

Arguments against Anti-Defection law

  • Defection is a matter of choice. 
  • Member's right to decide whom to support. 
  • In UK, Australia and the U. S. Parliamentarians take positions contrary to their parties or votes against the party's view, continue the same party. 
  • This law is curtailment to delegates freedom of choice. 
  • Partisan role of speaker.
